DIGITAL IMAGE LICENSE (2026)

IMPORTANT INFORMATION - EFFECTIVE JANUARY 1, 2026

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THIS WEBSITE OR MAKING A PURCHASE.

By purchasing, downloading, or using any digital photograph(s) from this website, you (“Buyer”) agree to be bound by the terms of this Digital Image License (“License”). If you do not agree to these terms, do not purchase, download, or use the Media.

1) DEFINITIONS

For the purposes of this License:

  • “Photographer” means Shannon Morse.

  • “Buyer” means the person or entity purchasing or accessing the Media.

  • “Media” means any digital photographs, image files, previews, watermarked images, and/or downloads made available on this website, whether purchased or viewed.

  • “Personal Use” means use for personal enjoyment only, including personal printing and private display, and does not include any Commercial Use.

  • “Commercial Use” means any use that is intended for or results in monetary compensation, brand promotion, sponsorship, advertising, marketing, or business exposure, whether direct or indirect.

2) COPYRIGHT AND OWNERSHIP

All Media is the property of Shannon Morse and is protected by copyright and other applicable intellectual property laws.

Buyer receives a limited license to use the Media under the terms below. Buyer does not receive ownership rights, and all rights not expressly granted are reserved by Shannon Morse.

3) LICENSE GRANT (PERSONAL USE ONLY)

Shannon Morse grants Buyer a non-exclusive, non-transferable, non-sublicensable, revocable, perpetual license to use the purchased Media for Personal Use only, provided Buyer complies with all terms of this License.

This license applies only to the Buyer. You may not share, transfer, or assign the license to any other person or entity.

4) WHAT YOU MAY DO (PERMITTED USES)

Buyer may:

  1. Print the Media for personal display, including prints for your home, personal album, or as gifts for family and friends (no resale).

  2. Display the Media privately on personal devices (example: personal desktop wallpaper or phone wallpaper), as long as the Media is not posted publicly as a stand-alone image and is not made available for download.

  3. Resize the Media only as needed for printing, provided the image is not otherwise creatively edited or altered.

5) WHAT YOU MAY NOT DO (PROHIBITED USES)

Buyer may not, under any circumstances:

  1. Resell, relicense, sublicense, redistribute, or share the Media, including sending files to friends, uploading to shared drives, posting in Discord servers, or placing the Media in any downloadable folder/library.

  2. Use the Media for any Commercial Use, including but not limited to:

    • advertising

    • marketing or promotions

    • brand/business social media accounts

    • product packaging

    • thumbnails, banners, channel art, or merchandising

    • sponsorships or affiliate marketing

    • subscription-based content (paid communities, paywalls, premium downloads)

  3. Upload the Media to any stock photography website, marketplace, print-on-demand service, template library, or digital product platform.

  4. Edit or modify the Media, including but not limited to:

    • cropping

    • filters

    • color changes

    • overlays, stickers, or text

    • removing watermarks

    • compositing with other images

  5. Use the Media in any trademark, logo, service mark, or brand identity.

  6. Use the Media in NFTs, blockchain-based projects, tokens, or digital collectibles.

  7. Use the Media in a pornographic, obscene, illegal, hateful, defamatory, or otherwise harmful manner.

  8. Make the Media available for download or public access in any form.

6) AI / MACHINE LEARNING / GENERATIVE TOOL PROHIBITION (NO AI USE)

Buyer may not use the Media for any artificial intelligence, machine learning, or automated system purpose.

This includes, but is not limited to:

  1. Uploading the Media to any generative AI tool or service for:

    • editing

    • enhancement

    • “AI retouching”

    • background replacement

    • inpainting or outpainting

    • image-to-image generation

    • style transfer

    • prompt-based image generation

  2. Using the Media as a reference image, prompt reference, or source material to generate new images or derivative content using AI.

  3. Using the Media for training datasets, model training, fine-tuning, or development of any AI system (including diffusion models, LoRAs, embeddings, or similar technologies).

This prohibition applies even if the Buyer claims the use is “personal,” “non-commercial,” “private,” or “just for fun.”

7) SOCIAL MEDIA TERMS

Buyer may share:

  • Links to Shannon Morse’s website pages featuring the Media

  • Links to Shannon Morse’s official social media posts featuring the Media

  • Reposts/reshares of Shannon Morse’s original uploads using platform-native sharing tools (example: repost/retweet/share)

Buyer may not:

  • Upload the purchased Media as a stand-alone image to social media

  • Screenshot, download, screen-capture, or repost the Media without permission

  • Crop, edit, filter, or apply AI tools to the Media prior to posting

If credit is permitted or requested in a specific case, credit must include “Shannon Morse” and a direct link to Shannon Morse’s official website or social media account.

8) ENFORCEMENT AND DAMAGES

Unauthorized use of the Media, including prohibited AI use, causes significant harm that may be difficult to measure.

If Buyer violates the AI / machine learning restrictions in Section 6, Buyer agrees to pay liquidated damages of $5,000 USD per image, in addition to any other remedies available to Shannon Morse.

Shannon Morse may also pursue all available actions, including DMCA takedown requests, platform enforcement, injunctive relief, and legal action where appropriate.

9) TERMINATION

This License automatically terminates if Buyer violates any term of this agreement.

Upon termination, Buyer must immediately:

  • stop using the Media in any way

  • delete all copies of the Media from all devices, storage, and backups under Buyer’s control

  • remove the Media from any website, platform, or publication where it appears

10) DISCLAIMER AND LIMITATION OF LIABILITY

The Media is provided “as is” without warranties of any kind, express or implied.

To the maximum extent permitted by law, neither Shannon Morse nor any associated vendors shall be liable for any indirect, incidental, consequential, special, or punitive damages arising out of the use or inability to use the Media.

11) DIGITAL PRODUCT SALES POLICY

Due to the nature of digital products, all sales are final once the Media has been delivered or made available for download, except where required by applicable law.

12) PHOTOGRAPHER’S RIGHTS

Shannon Morse retains the right to use the Media for her own portfolio, website, social media, marketing, editorial use, publication, licensing, or any other lawful purpose.
